1.1 FLAREgamer ("FG") may from time to time change the terms that govern your use of the site. Your use of our site constitutes your agreement to follow and be bound by the terms as changed.

Content
2.1 Unless otherwise noted, photographs, audio and video clips, graphics, links, written and other material (collectively, the "Content") that appear as part of this site are copyrighted as a collective work of FG pursuant to applicable copyright law.

2.2 You may download, copy and make any personal, non-commercial use of the Content and Material and use that is permitted by Sections 107 through 122 of the United States Copyright Act of 1976, as amended ("Copyright Act") and not prohibited by any section of the Copyright Act or by any other applicable law, rule or regulation; provided, however, that you maintain all copyright and other notices contained in such Content.

2.3 FG reserves the right to delete, move or edit any Content or Material (including Material posted in digitalFLARE) from time to time. FG has the right, but not the obligation, to correct any errors or omissions in any Content, as it may determine in its sole discretion.

Indemnification
3.1 You agree to defend, indemnify and hold FG harmless from and against any and all claims, damages, costs and expenses, related to your use of the site.

Disclaimer
4.1 FG's content is distributed on an "As is, as available" basis. No part of FG, third party content providers and their respective agents make any warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose. You expressly agree that the entire risk as to using the site and content is assumed solely by you.

Termination
5.1 This Agreement is effective until terminated by either you or FG. You may terminate this Agreement at any time. FG also may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the site if in FG's sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or FG, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the terms of this Agreement or otherwise.
